The liability system worked differently in Italy when I was there.
If you had an accident of any kind you automatically went to court and the judge decided what both parties responsibilities and liabilities were on the spot. If you didn't like what he ruled you could end up in court for years while the interest piled up if you lost.
A friend hit a chicken at high speed. The owner caught his license number and reported him to the Police. At his ticket hearing the lawyer he brought advised him to pay the judgment for the chicken and the thousands of eggs it would have laid and the value of the 10 generations of egglayers following it -About $2500 US at the time (~1969)
The alternative was years of appeals and many thousands in lawyers fees as well as potential jail time because it was a Criminal case-Wilfull Destruction of private property.
So he paid despite the fact it was a Rooster
BUT no one was suing anyone over things like this- they didn't have to because the system already covered it.
