I'm not expecting on having to sue anyone.

He claims to have been around since 1996 (according to his copyright), but his birthday is 1/23/1989 and that would make him 7 when he started the company, so I'm thinking that's bs.

Best case is he goes "omg, omg omg" and changes his name to like Quail Studio. heh

All I want is to protect our branding. I will take further legal action if necessary though. I don't want a client searching google for Penguin Studio and finding him instead and getting confused thinking i'm some punk 16 year old with aol dialup.

it doesn't look like you'll have a problem with the kid stealing any of your business. his intro page looks very amateur; it is certainly not professional. he has hardly any META tags. the splash only shows that he can't use flash beyond a beginner level, and I dunno how it looks to people in IE, but in firefox I could hardly find the skip into hyperlink. once I finished the hunt for the skip into link, I found that his webpage looked much better but its still nothing an un-artistic person couldn't come up with spending a couple hours in frontpage or some other web designing crutches.

btw, nice website komodo.

I also do web design. actually I'm more of just a digital artist, but I'm done doing it for money.

interesting, he seems to do a lot of local work, if you look at his previous clients, i think all but 1 or 2 of the companies he is doing work for are based in paterson, NJ, and a few of those are the Paterson, NJ police force

You're coming off as a prick. You are attemtpign to bring EXPENSIVE legal actions agianst a 16 year old kid. Rethink how you present your company. This kind of attitude is what kills a loyal customer base.

what? the kid is stealing his business, if the kid had a totally different name i doubt harry could care less, but just like harry said, if someone is searching for penguin studioS and penguin studio comes up, he may get confused, and that attitude doesnt kill any customers, just competitors

and lastly, he isnt really taking any legal action, unless the kid refuses, which i doubt he will

Plenty of businesses carry the similiar names -- sometimes the same, correct me if I'm wrong but you copyright the way your service/product is presented...i.e words/images. As long as the kid has a business license with that name registered.
