I called the credit card people. The amount was posted early this morning. They told me it would take several weeks to arbitrate. The charge however will stay on until the arbitration goes my way, assuming it does that is. They are not allowed to remove a pending transaction. I asked several times.

I'm not really worried about being sued, I am worried about loosing $2,500. I'm sure most here will admit that giving away $2500 to a dealer for no real service is robbery.

I need to talk to someone who is a licensed Lawyer. Just so that I can have some sort of reassurance and advise. Again, I never got a VIN number nor did I drive a car off the lot. I asked for my money back after signing a contract due to them not satisfactorily fulfilling the contract. I told them I wanted to take my business elsewhere. He called me unprofessional.

So somebody please help me with this. I may post something in the member sections, since there's more traffic in there.

just a suggestion, kinda like taking the loss, tell them you want the car w/200 miles only if they drop the price, lets say another 1000, they'll most likely say no however you can say that you tried to negotiate with them and they declined

Well then, it's been an interesting week.

So after calling up Springfield Acura and getting nowhere with the mofioso looking son of a bitch manager, I had to go there in person. Of course, being the pussy that I am, I couldn't go alone. I asked my father to come with me and on President's Day, we went in. I was so nervous, it's only out of frustration and heightened anger. Mr. Mofioso came over, my father in his rather broken English explained to the guy the situation. Mr. Mofioso took us into his tiny cubical sized office. There he explained, in his tough mannerisms, that I had signed a contract. My reaction was simply, "I am not satisfied with the service I had gotten, I want my money back." Again, "You signed a contract......" was repeated. One can't help but get a bit (ok more than a bit) upset when the same bullshit comes up. So, I went to the next level. I told him that he didn't sell me a car, there is no VIN number on the order form. How can you sell me a car with no VIN? "You signed......" He then went on saying my car is on the way, he had just put in an order for it and it will be there soon. This is after I had told him to nix the order.... mofo is trying to really get me to buy a car. This is how those fuckers at that dealership work with customers. Their scare tactics are way up there. Sure, all smiles in the beginning, but when the shit hit's the fan, they get aggressive, real aggressive.

The whole time that we were talking, he wasn't talking to me, the fucking customer, he was talking to my father. That really upset me. It's my money, I'm the one with the finger on the HOLY SHIT button, ready to call the Bank, BBB, and Acura/Honda.

More words were exchanged, I honestly don't remember what was said in specific. He begins to mention that he's never been spoken to like I was speaking to him, which, I was angry, but I wasn't yelling nor was I insulting him personally. He said that he has kids my age and blablabla... "I don't care about your kids.... what do they have to do with this..." After I said that, that's when he lost it, Mr. Mofioso stood up and started to rant saying that he doesn't care if I get a lawyer, that is how we are going to get it done. I was ordered to leave or he'll call the police, on me... THE FUCKING CUSTOMER! I called to my father sitting next to me, "Let's GO!, We'll get our lawyer, Give my my fucking paper back [the no VIN recipt that Mr. Mofioso used to point out where I had signed]" and I started to leave. My father just sat there. I'm confused, thinking that he's trying to be a hero. Mr. Mofioso closed his tiny office door on me and those two had a closed door meeting.

NOW I'M FUCKING FUMING!!!!! I wanted to get a bat and break every fucking window there then kill Mr. Mofioso. I tried my best to compose myself and walked back to my dad's car and waited. Called the girlfriend, vented on her answering machine and 10 minutes later, dad came out of the dealership. He quietly sat in the car and said, "Don't worry, your getting your money back."

WTF? I have no idea what happened but he had "bonded" or said something that made Mr. Mofioso come to terms.

It was confirmed on Friday morning, my $2500 deposit was returned via credit company.

Well, as some of you may have noticed, my sig has changed. I am the new owner of a 2007 Acura TSX which I took delivery of today at Bridgewater Acura. I'll make up a post sometime this weekend about it in detail in a new thread.

So, this makes the end of this topic. The decision was made and a vehicle was purchased. Thank you to all whom have responded and given advice. I am not exactly turning my back on BMW, I just can't afford to give my first born anymore. There may be a time in the future when I can afford an E30 M3 plaything, but until that point, I'll have to make do with what I got.

I'll never find out, but I'll tell you this. My father had an enemy at his job. One day, during work, he had gone too far and my dad said, "I put a gypsy curse on you" and left it at that. The following night, there was a sudden thunder storm and that man's car was the only car crushed by a tree, even though there were other cars around it. Work of a gypsy curse? Maybe......

I got a picture of him with the car... a memento if you will.
