I don't think that there's anything wrong with it, I think all bmw tranny's have delayed shifiting. It will be delayed unless you put a short shifter in.

thanks for the responses, this morning when I drove I noticed that it shifts from 1 to 2 ok its just going into 3rd there is a delay so i dont know it actually seems more powerful anyway i looked at the service records and it said: cust. states: will not engage into gear internal unit failure rebuild transmission complete also where do you get the info from the bulletion?

I had same like this prob in my other car 320i. It delay & tough shifting from 1-2. and after driving a while this prob. disappear. this thing happen when I parked the car for more than 1 hour. I used the car for 2 years with this problem in the transmission.
after that an inexperienced workshop changed the fluid by a normal one , which cause a fail in gearbox. this is the only reason which let me replace the transmission.
eventhough I replace it, that problem still avilable!!??. I dont know what was the reason of this, I think in many things that cause this problem( control unit, wiring, a sensor....etc). and I never found the solution. so I'm driving my car with this problem until now. I just have to heat up the car well before driving. then this prob. well disapear gradually.

So what wound up happening with your tranny? Is it just shifting at a higher RMP point, or is it a true slippage, where the RMPs will shoot up and then the tranny will bang into gear?
The slippage wouldn't likely go away after the car has been driven a while. Does this happen only when it's cold out, or during warmer weather as well? I know the the ECU (Electonic Control Unit) has programming to elevate the shift points in cold ambient temperatures in order to bring the car up to operating temp faster. This is factory programmed. You exprience of it shifting fine after reaching operating temp leads me to think that this is the case.
Although it probably doesn't hurt to change the fluid and filter, just as means of checking the quality of the fluid since the rebuild. Depending on how many components they replaced with new ones, the tranny could have gone through a new break-in period and you may have abrasive particles in the fluid. New fresh fluid never hurts, you'll extend the life of your tranny as well. Just make sure it is refilled to the correct level. A second and/or third fluid / filter replacement shortly after the first one, is just has important as the initial one, in case the detergents in the new fluid clean some of the deposits or sludge. That's the best way to keep everything running as smooth as possible.
At the same time, make sure that the cooling lines, and/or the cooler don't have any restrictions or blockages, altering the fluid pressure, that will sure cause erratic shifting as well. Good luck, keep us updated...

Uhhh sounds like the tranny speed sensor, which is located on top of the transmission, its on top of the output shaft usually on the a4s 310r at least.

Thanks for your response, I actually had the car brought to the dealer to check it out and they said everything was normal so I guess it is just a trait of these cars. I dont Know... I think eventually Ill change the fluid to see if it helps. Maybe what happen was when the transmission was rebuilt the previous owner didnt break it in like you were saying. It is definitely not slipping it just takes longer to get out of the gear but it is more noticable when going into third. I have to press the gas harder then it will get out of the gear(dont know if that makes sense) and it happens during hot and cold weather.
Im pretty sure its fine though. When it is warm it drives perfectly.
