so the last few years of the E46 featured LED tail lights. thats a nice upgrade.

but now the E90/92 has regular bulbs. why would they go back to that? was something not working right?

i doubt that, but i bet they will come out with LED tails later in the E90/92.

anyone care to weigh in?

As designers and fabricators of exhibitions at my job, we don't look at things like that as "upgrades" or "bettter". It depends on the design spec, and what the creators envision the car looking like. Maybe they felt that LED's clashed with the aesthetics. Personally I like it with incandescent lighting. What I don't like is that white/silver outline on the lense.
