My name is Harry Maugans and I founded and operate a company called Penguin Studios. We are legally incorporated and have followed all measures to legally protect our name and branding. We’ve done work for CompUSA, Chevron, Texaco, Marathon, Expedia.com, and a few other high profile clients, one of which alerted me to your site this evening. Your company’s name is infringing upon our incorporation, legal copyrights, and trademarks, and may confuse potential clients searching for Penguin Studios with online search engines. I’ll be contacting my attorney tomorrow to ensure our legal security, however I wanted to first contact you and inquire about a course of action to move forward. Be aware, I am taking this matter very seriously and will take legal action if no resolution is promptly found.
I also see on the bottom of your website a copyright notice from 1996-2005 for your company, however I can’t believe such a similar copyright would clear. I have a screen shot of the website and will also ask my attorney to submit a Search Request to the US Copyright Office for the validity of such a claim. Forgery of online copyrights violates Circular 66 of Federal Copyright Law, unless legally officially declared with form 17 U.S.C. sec. 102 in 1996, as you published. If declared Willful Infringement for Profit, as this appears to be, it’s valid grounds for criminal prosecution.
If I do not hear back from you within 48 hours, we’ll move forward to the next step. Consider this a written, documented warning.
